Terms of Service
Last updated: October 16, 2026
These Terms of Service ("Terms") are an agreement between Kashela LLC ("Kashela", "we") and the business that signs up for the Kashela software ("Business", "you"). By using the Service you agree to these Terms.
1. The Service
Kashela provides cloud software for service businesses, including booking, check-in, checkout, payroll calculation, rewards, gift cards and reporting. Features may change as we improve the Service.
2. Accounts
You are responsible for your account, for the people you give access to, and for keeping logins secure. Tell us right away at support@kashela.com if you believe your account has been accessed without permission.
3. Free trial and fees
- New Businesses may receive a free trial. At the end of the trial, the Service continues on the plan you choose and is billed monthly in advance.
- You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are not refunded except where required by law.
- Prices exclude applicable taxes. Sales tax may apply depending on your location, including in Texas.
- We may change prices with at least 30 days' notice.
4. Payment processing
Card payments are processed by a third-party payment processor under a separate agreement between you and that processor. Processing fees, deposits, chargebacks and disputes are governed by that agreement. Kashela does not store full card numbers or security codes and is not a party to your processing agreement unless stated in writing.
5. Your data
You own the data you and your staff enter into the Service, including client information. You grant Kashela permission to host and process that data only to provide the Service. You are responsible for having the right to collect your clients' information and to send them messages, including obtaining any consent required for text messages. You may export your data at any time while your account is active.
6. Acceptable use
You will not use the Service to break the law, send spam, interfere with the Service, or attempt to access other Businesses' data.
7. Availability
We work to keep the Service available and secure, but it may occasionally be interrupted for maintenance or reasons outside our control. Your card terminal may continue to accept cards during an interruption.
8. Disclaimers and limitation of liability
The Service is provided "as is". To the extent allowed by law, Kashela is not liable for indirect, incidental or consequential damages, or lost profits, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.
9. Termination
We may suspend or end access if you seriously breach these Terms or do not pay fees when due. After termination you may request an export of your data for 30 days.
10. Governing law
These Terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts located in Denton County, Texas.
